THE DANGERS OF CEDING LEGAL LAND OR TERRITORY WHEN MAKING PEACE IN CONFLICTS
The purpose of this write-up is to give an opinion of what happens when legal territory is negotiated in peace deals.
For every conflict, it is important to know all the combatants, especially those at the root. This is because those actually involved in the hostilities may not be the only combatants.
This is very important.
When a piece of legal territory is being negotiated, it is not only the overt combatants that have something to do with it, but also the covert or not-so-seen combatants. What this means is that if territory is actually ceded through a negotiation, those who control and or have influence over the territory would not only be the overt combatants, but most likely the covert combatants as well, whether directly or indirectly.
What is the challenge with this?
This could be precarious because it cannot always be easy to ascertain the impact of covert combatants on a ceded territory.
For instance, if a covert combatant or an overt combatant has further territorial ambitions, then the ceding of territory provides legal ground to achieve this or try to achieve this at a later time. In essence, ceding territory in peace deals may actually facilitate conflicts at later times.
More importantly, an overt combatant on the same side with a covert combatant today may not be on the same side tomorrow. Therefore, even if the overt combatant does not have any further territorial interest, if the covert combatant has, this could be a source of danger not only to the nation which ceded territory, but also to the overt combatant who is known as the combatant and wants to maintain the peace. Since the covert combatant feels a right to the ceded territory, this could be a challenge at some point for the overt combatants, even though they may be on different sides.
This could also be true if there are interests or entities involved which may overtly support or associate with combatants but may not actually be combatants in the true sense.
Therefore, the ceding of territory is a very serious issue with many implications.
Demilitarised zones while maintaining legality, sovereignty and territorial integrity and legally offering legal independence to locations of intractable conflict according to Universal standards and or the standards of the United Nations could be considered.
However, ceding of territory is a foothold and should be studied with tremendous caution.
